In the field of rural domestic wastewater treatment, Zhejiang Province has now formed its own unique policy system and issued more than ten relevant laws and regulations covering the construction, technical transformation, management, operation and maintenance of wastewater treatment facilities, providing a reference template for other places. Among them, the "Regulations on the Management of Rural Domestic Wastewater Treatment Facilities in Zhejiang Province" promulgated in September 2019 is the first provincial-level local regulation specifically for the management of rural domestic wastewater treatment facilities in China, which covers the construction, transformation, operation and maintenance of rural domestic wastewater treatment facilities. It fills in the blank that there is no direct legal basis for the management of rural domestic wastewater treatment facilities. It is very important to ensure and promote the treatment of rural domestic wastewater, improve the rural living environment and ecological environment, build beautiful villages, and boost the rural revitalization.
Clarified the scope of rural domestic wastewater. Based on the legislative purpose of improving the rural living environment and ecological environment, the regulation expands the scope of rural domestic wastewater described in relevant national documents, and defines it as wastewater in three aspects, including wastewater generated in the daily life of rural villagers, wastewater generated by public welfare undertakings and public services, as well as wastewater generated by operating activities such as homestays and farmhouses.
Regarding the scope of rural domestic wastewater treatment facilities. In a broad sense, all facilities that have the functions of receiving, transporting, and disposing rural domestic wastewater belong to rural domestic wastewater treatment facilities. However, the simple treatment facilities built by a single family for self-use or shared by a small number of families for on-site disposal of domestic wastewater, such as independent septic tanks, are completely private issues and do not require public power to intervene in management. Therefore, the regulations explicitly exclude those conditions. In addition, some rural domestic wastewater receiving and conveying pipelines are eventually connected to urban wastewater treatment facilities to form a pipe network; however, due to various factors, the operation and maintenance units of urban wastewater treatment facilities are not all responsible for the operation and maintenance of the entire pipe network. In this case, the local government needs to make a definition to clarify the main body of operation and maintenance responsibility and the applicable legal system to prevent management vacuum.
Determination of the main body of operation and maintenance. Rural domestic wastewater treatment facilities include indoor treatment facilities and public treatment facilities. Based on the different nature of ownership, operation and maintenance entities should be defined separately. The indoor treatment facilities are privately owned by the villagers, and the villagers are the main body of operation and maintenance. Public processing facilities are owned by the state, and the township government or county (city, district) operation and maintenance department shall exercise the ownership and management power on behalf of the state as the main body of operation and maintenance. However, the township government or county (city, district) operation and maintenance department generally does not have the professionals and the ability to operate and maintain public processing facilities, and can entrust professional third-party operation and maintenance units to operate and maintain; Treatment facilities that are simple and require relatively low technical requirements for operation and maintenance can also be commissioned for operation and maintenance by the village collective economic organization.
Regarding the behavioral norms of third-party operation and maintenance units. The core of rural domestic wastewater treatment facilities is public treatment facilities, and most public treatment facilities are commissioned by third-party operation and maintenance units to operate and maintain. Therefore, standardizing the behavior of operation and maintenance units is very important to ensure the operation and maintenance of treatment facilities. Since there is a contractual relationship between the government and the operation and maintenance unit, the code of conduct of the operation and maintenance unit should mainly be specified in the operation and maintenance service contract signed by the two parties. The regulations only cover the key links in the operation and maintenance activities of public treatment facilities, such as water inlet and outlet. Provisions shall be made for water quantity and water quality testing, as well as the disposal of facility damage, malfunction, and outage, and so on.
The principle of charging for rural domestic wastewater treatment. The "Regulations" clearly follow the principle of who discharges who pays, and gradually establishes a rural domestic wastewater treatment fee system. The specific measures for fee charging and use management shall be formulated by the county (city, district) people's government in accordance with relevant national and provincial regulations and in accordance with local conditions. If the wastewater treatment fee is included in the rural domestic water fee, no additional wastewater treatment fee will be charged.
