At the legal level, China has not issued a special law on rural wastewater. Neither “Water Law” nor “Water Pollution Prevention and Control Law” sets out specific requirements and specify the specific responsible departments for rural wastewater.

 

In 2008, the Ministry of Housing and Urban-Rural Development was established in accordance with the State Council's Institutional Reform Plan, and its official document included the work of "guiding the improvement of the ecological environment of human settlements in small towns and villages". Since then, the Ministry of Housing and Urban-Rural Development has been actually promoting the guidance of rural domestic wastewater treatment at the central level.

 

In 2018, the Ministry of Agriculture and Rural Affairs and the Ministry of Ecology and Environment were established in accordance with the Institutional Reform Plan of the State Council. Their official documents both include the responsibility of "guiding, coordinating and supervising rural ecological and environmental protection". Therefore, the specific work of these two ministries also includes contents related to rural domestic wastewater.

 

In November 2018, the Ministry of Ecology and Environment and the Ministry of Agriculture and Rural Affairs jointly issued the "Notice on Printing and Distributing the Action Plan for the Battle of Agricultural and Rural Pollution Control" (Huan Soil [2018] No. 143), in which it is clear that the treatment of rural domestic wastewater should be promoted step by step; the Ministry of Agriculture and Rural Affairs, the Ministry of Housing and Urban-Rural Development, the Ministry of Ecology and Environment, the Health Commission, and the Ministry of Water Resources are all responsible according to the division of responsibilities. This shows that rural wastewater treatment is in multi-management state.

 

In July 2019, the Central Leading Group for Rural Work and other eight ministries jointly issued " Guiding Opinions on Promoting Domestic Wastewater Treatment" (Zhongnong Fa [2019] No. 14), which clearly states that the agricultural and rural departments will take the lead in improving the living environment in rural areas, and the ecological environment department will focus on the treatment of rural domestic wastewater.

 

In January 2021, the National Rural Revitalization Bureau was established. It was reorganized from the State Council Poverty Alleviation Office and is a national bureau under the escrow of the Ministry of Agriculture and Rural Affairs. Its main task is to effectively connect the achievements of consolidating and expanding poverty alleviation with rural revitalization.

 

In February 2022, the director of the Central Agricultural Office and the Minister of the Ministry of Agriculture and Rural Affairs explained the specific division of labor between the Central Agricultural Office, the Ministry of Agriculture and Rural Affairs and the National Rural Revitalization Bureau: the Central Agricultural Office is responsible for leading the implementation of the rural revitalization strategy, the Ministry of Agriculture and Rural Affairs is responsible for the overall implementation, and the national The Rural Revitalization Bureau is responsible for the specific implementation; although the functions of the three are different, they still need to work together to promote the rural revitalization work in an orderly manner from different angles and at different levels.
